Section 1: Nature of Service

1.1 Software Status

The Application is provided as-is. Dialogi is an independently developed mobile application currently offered in its current release state. The Developer makes no representations that the Application is error-free, uninterrupted, or suitable for any particular purpose.

1.2 Service Interruptions

The Application depends on third-party services including OpenAI (GPT-4o, Whisper), Firebase (Google LLC), and Apple's infrastructure. The Developer does not guarantee uninterrupted availability. Service may be temporarily unavailable due to scheduled or unscheduled maintenance; third-party service outages; force majeure events; or technical failures beyond the Developer's reasonable control.

1.3 Right to Update

The Developer reserves the right to modify, update, suspend, or discontinue any part of the Application at any time. Continued use after an update constitutes acceptance of the updated version.

Section 2: Data Privacy

2.1 Overview

Your privacy is important to the Developer. The full details of how your data is collected, processed, stored, transferred internationally, and your rights as a data subject are set out in the Privacy Policy, which is incorporated into these Terms by reference.

2.2 Voice, Image, and Text Input

Your content is never stored. Voice recordings, images, screenshots, text input, and profile information are all processed transiently. Your input content exists in memory only for the duration of a single API call and is permanently deleted immediately thereafter.

2.3 PII Redaction

Before any content is transmitted to backend servers or external APIs, the Application automatically redacts personally identifiable information from your input using on-device pattern matching: email addresses, phone numbers, IBAN numbers, credit card numbers, national identity numbers, passport numbers, dates of birth, and GPS coordinates.

2.4 Data We Do Collect and Retain

The Application collects and retains limited data linked to your account: Firebase Anonymous UID, Device ID, subscription status and usage counters, FCM token, crash logs (max 30 days), and user feedback/reports. Your IP address is received but NOT stored. See the Privacy Policy for full details.

2.5 Third-Party Services Disclosed

• OpenAI (USA): Processes voice transcription and text generation under Zero Data Retention policy.
• Firebase / Google LLC (USA): Provides authentication, cloud database, crash reporting, push notifications, and Remote Configuration.
• Apple Inc. (USA): Handles all payment processing for subscriptions under its own Privacy Policy.

2.6 Account Deletion

You may delete your account at any time using the "Delete Account" button in the Application's Profile screen. All associated data is permanently and irreversibly deleted.

Important: Account deletion does not automatically cancel any active subscription. You must cancel your subscription separately through your Apple ID subscription settings.

2.7 KVKK Rights

If you are located in Turkey, you have the rights set forth in Article 11 of the Turkish Personal Data Protection Law (KVKK No. 6698). To exercise these rights, contact fhouse.floatinghouse@gmail.com.

Section 3: User Obligations

3.1 Legal Compliance

You agree to use the Application only for lawful purposes and in accordance with these Terms. You represent that you have the legal capacity to enter into this agreement, your use complies with all applicable laws, and you will not use the Application to generate illegal, defamatory, harassing, fraudulent, or harmful content.

3.2 Prohibition of Misuse

You may not use the Application to: generate spam or mass communication campaigns; impersonate any person or entity; reverse engineer, decompile, or disassemble the Application; attempt unauthorized access to backend infrastructure; damage, overload, or compromise servers; circumvent usage limits or subscription restrictions; or use automated scripts or bots.

3.3 Account Security

You are responsible for maintaining the security of your device. If you believe your account has been compromised, contact fhouse.floatinghouse@gmail.com immediately.

3.4 Age Restriction

The Application is rated 17+ and is intended for users aged 17 and older. If you are under 17, you must not use the Application.

3.5 Content Reporting

The Application includes a "Report Content" button in the result screen, available to all users including free tier users.

Section 4: Service Tiers

4.1 Free Tier

Dialogi offers a free tier with limited message generations per day, standard communication tones and templates, basic voice-to-text, and local message history. Limits may be adjusted by the Developer at any time.

4.2 Subscription Features

Premium subscriptions unlock additional functionality including higher or unlimited message limits, advanced tone options, enhanced AI capabilities, priority processing, and additional customization features.

Section 5: Subscriptions and Payments

5.1 Purchase Terms

All purchases are processed through Apple's App Store in-app purchase system. Current subscription options:

5.2 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends. You can manage and cancel your subscription at any time through your Apple ID Account Settings > Subscriptions.

5.3 Free Trial

Free trial periods may be offered at the Developer's discretion. Any unused portion of a free trial is forfeited when a subscription is purchased. You will be charged at the end of the trial unless you cancel before it ends.

5.4 Refunds

All refund requests must be directed to Apple at reportaproblem.apple.com. The Developer cannot issue refunds.

5.5 Price Changes

Existing subscribers will receive notice from Apple at least 7 days before a price change. Price changes will not affect the current paid period. You may cancel before renewal if you disagree.

Section 6: Intellectual Property Rights

6.1 Application Ownership

The Application is owned exclusively by Zeynep Türker. All rights are reserved. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application on Apple-branded devices you own or control.

6.2 Prohibited Activities

You may not copy, modify, distribute, sell, sublicense, or create derivative works based on the Application; reverse engineer or extract source code; remove proprietary notices; or use the Developer's branding in a misleading manner.

6.3 User Content

You retain ownership of content you input. The Developer does not claim ownership and does not use your input to train AI models.

Section 7: Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

The Developer expressly disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement; warranties of accuracy, reliability, or quality of AI-generated content; and warranties regarding third-party service availability.

This section does not affect any statutory rights you may have as a consumer under applicable Turkish law.

Section 8: Limitation of Liability

8.1 Exclusions

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

8.2 Maximum Compensation

The Developer's total cumulative liability shall not exceed the total subscription fees paid by you in the twelve (12) months preceding the claim. For free tier users, maximum liability is limited to fifty (50) Turkish Lira.

Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Turkish law.

Section 9: Account Termination

9.1 Termination by User

Deleting the Application from your device does NOT cancel your subscription. To cancel: iPhone Settings > [Your Name] > Subscriptions > Dialogi > Cancel Subscription.

To delete your account and all data, use the "Delete Account" button in Profile. This is permanent and irreversible.

9.2 Termination by Developer

The Developer may suspend or terminate your access if you violate these Terms, create legal or reputational risk, or if required by law. Termination does not relieve your obligation to cancel your subscription through Apple.

Section 10: Legal Disputes

10.1 Governing Law

These Terms are governed by the laws of the Republic of Turkey.

10.2 Jurisdiction

The courts of Balıkesir, Turkey have exclusive jurisdiction.

10.3 Language Governing Clause

These Terms are published in both English and Turkish. In the event of any conflict, the Turkish version shall prevail.

10.4 Dispute Resolution

Before formal proceedings, both parties agree to attempt resolution through written notice and a thirty (30) day negotiation period. This does not constitute arbitration.

Section 11: Force Majeure

The Developer is not liable for failures caused by events beyond reasonable control, including natural disasters, war, pandemics, government orders, third-party service outages (OpenAI, Firebase, Apple), internet infrastructure failures, or cyber attacks. If a Force Majeure Event exceeds ninety (90) consecutive days, either party may terminate without liability.

Section 12: General Provisions

12.1 Change Notification

The Developer will notify users of material changes via in-app notification and by updating the "Last Updated" date. Continued use constitutes acceptance.

12.2 Partial Invalidity (Severability)

If any provision is found invalid, it shall be modified or severed. Remaining provisions continue in full force.

12.3 Waiver

No failure to exercise a right constitutes a waiver of that right.

12.4 Assignment

You may not assign your rights without the Developer's written consent. The Developer may freely assign these Terms with reasonable notice.

12.5 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement. In the event of inconsistency, the Privacy Policy governs data processing matters.

Section 14: Apple-Specific Provisions

14.1 Acknowledgment

These Terms are between you and the Developer only, not Apple. Apple has no obligation for maintenance, support, or warranty. Apple is not responsible for addressing claims related to the Application or intellectual property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms.
