Terms of Use

1. Acceptance of the Terms

By accessing and utilizing the mobile application "PLATÉ" and related services provided by Zeynep Türker ("Developer", "we", "us", or "our"), you acknowledge and agree to be legally bound by these Terms of Use ("Terms"). If you do not accept these Terms, please refrain from using our applications or services.

2. Modifications to the Terms

The Developer reserves the right to revise or update these Terms at its sole discretion. Any updates will be reflected by posting the revised Terms on our applications, along with an updated "Last Updated" date. Continued use of our services after changes have been made signifies your acceptance of the revised Terms.

3. Use of Services

3.1 Eligibility

You must be at least 12 years of age (or older, depending on your region's App Store rating for this App) to use our services. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian to access and use our services.

3.2 User Account (Anonymous & Device-Based)

Our Service operates without traditional login credentials (username/password). Your account and "Coins" are linked to your device's unique identifier or iCloud account.

By using the service, you agree that:

• You are responsible for the security of your device.
• If you delete the app or reset your device without a cloud backup, you may lose your Coin balance.
• We cannot recover accounts that are lost due to device reset or app deletion if strictly anonymous.

3.3 Prohibited Conduct

You agree not to:

• Use the services for unlawful purposes.
• Generate content that includes nudity, violence, hate speech, or illegal acts.
• Attempt to reverse engineer the AI models or API.
• Violate applicable laws or regulations.

4. Intellectual Property

All components of our applications — including software, functionality, logos, and UI — are the exclusive property of the Developer. You may not copy, modify, or distribute any part of the application without written permission.

5. User Content & AI Generations

5.1 Ownership & License

You retain full ownership of the photos you upload. However, by uploading, you grant us a temporary license solely to process the image through our AI providers to generate your result.

5.2 AI Disclaimer

You acknowledge that:

• The Service uses Artificial Intelligence (AI) to generate images.
• AI may occasionally produce artifacts, errors, or unexpected results.
• You are responsible for the content you generate.

5.3 Content Standards

You agree not to use the AI to create content that violates third-party rights, is defamatory, offensive, or illegal. The Developer reserves the right to suspend users who repeatedly attempt to generate prohibited content.

6. Subscriptions and Payments

6.1 Coin System

PLATÉ uses "Coins" to access features:

• Coins are purchased via In-App Purchases.
• Coins are consumable items and are generally non-refundable once used.
• Unused coins do not expire unless the app is discontinued.

6.2 Subscription Services

The App may offer weekly or monthly subscriptions.

• Pricing: Current pricing is displayed clearly on the purchase screen within the App.
• Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Cancellation: You can cancel anytime via your Apple ID / App Store settings.

6.3 Payment Processing

All transactions are handled by Apple (App Store). We do not store your credit card details.

6.4 Refunds

Refund requests for subscriptions or unused coins are handled exclusively by Apple according to their Refund Policy. We do not have the ability to process refunds directly.

7. Privacy

Your use of our services is subject to our Privacy Policy.

• We use anonymous authentication.
• Photos are processed temporarily via Google Cloud AI.
• We do not sell your data to third parties.

8. Disclaimers

All services are provided on an "as is" basis. We do not guarantee that AI-generated results will always meet your specific artistic expectations. AI generation is an experimental technology.

9. Limitation of Liability

To the maximum extent permitted by law, the Developer shall not be held liable for any indirect damages, loss of data (including Coins lost due to device changes), or service interruptions.

10. Indemnification

You agree to indemnify the Developer against any claims arising from your use of the services or violation of these Terms.

11. Termination

• By You: You may stop using the service by deleting the app.
• By Us: We may terminate access if you violate these Terms (e.g., generating illegal content).

12. Governing Law

These Terms shall be governed by the laws of Turkey. However, if you are a consumer in the UK or EU, you also benefit from mandatory provisions of consumer protection laws in your country of residence.
